Selection order for dismissals and layoffs in detail

If multiple employees in the same position are to be dismissed for economic reasons, employers cannot randomly select them.

Employers must produce selection criteria in the form of a proposal specifying which employees would be dismissed, consult with affected employees on these criteria and give them the opportunity to provide feedback.

Although there is no prescribed, statutory method for calculating the order of dismissal, a formula may be set out in the collective employment agreements of some union employees.
